Did you know that Customs requires you to also keep import records? Not only the broker has to maintain import records for 5 years from the date of entry but you do also. You must also keep your purchase orders, all Customs papers, invoices, receiving reports, distribution records, etc. You also must keep a log or otherwise be able to match up a Customs entry number to your specific shipment. When we invoice you, at the top of the Customs entry form is the entry number. You must keep some sort of log to match to your shipments. If Customs, FDA or any of the other 58 agencies involved in import have a question, they will provide the entry number alone. It is not the brokers job to maintain or look this up for you. We do not provide recordkeeping for our clients unless is it specificially contracted and paid for.

Are you using a legal broker for your clearances? Do you even know what a legal broker is? A broker must be licensed by Customs & Border Protection, also known as CBP. It is a very hard test to pass and the rate of passing is usually around 5% each time it is given, which is usually twice a year. Only a licensed broker can clear shipment through Customs. Only a licensed broker can advise you what the duty rate will be for your shipment. Only a licensed broker can offer any advice on Customs matters. Freight forwarders cannot do any of these items legally. Protect youself and your business by asked for a licensed broker now!

To verify, ask your broker for a copy of their license. If they are really licensed, they will happily give it to you. Many freight forwarders pass themselves off as licensed brokers or one stop freight handlers, when in fact they are not. Some of those freight forwarders do actually hire licensed brokers like ourselves to handle their clearances. They do not hide the fact that they are subcontracing out to a licensed party. If they are hiding the fact they are not licensed or hiding the fact they are using a third party broker to clear your shipment, you have to wonder. What else are they hiding from you!

Do you suffer from e-mail organization problems? Are you using Outlook? Don’t you hate the way it takes forever to do searches? We have been using NeoPro for many years now and found it to be great. You no longer have to put your e-mails into folders. The search function will immediately list all e-mails, sent and received, containing any text you type in. It also has handy presets with “today”, “yesterday”, “this week”, “last week” etc. This is invaluable. Many times I am looking for something I received yesterday or today. Just one click brings it up.

This is how we use it. Only new emails and current ones requiring some action are kept in the “active” preset. That way, you are not overwhelmed with things that have been acted on or you can get very disorganized otherwise. After the e-mail is read and you no longer need it, press one key that you select, we use the backspace key, and it is filed away for you. It removes it from your active box and keeps it clean. Check it out. This is not a paid promotion and we received nothing in return. We just wanted to promote something we find invaluable.

CBP has announced its intent to aggressively target entries made under various preference programs and free trade agreements (FTA), including claims made under Chapter 98, GSP, DR-CAFTA and NAFTA. According to its 2010 audit plan, CBP will significantly increase the use of Quick Response Audits (QRA), which often target preference program and FTA claims. Failure to support these claims will lead to denial of preferential benefits, as well as potential monetary penalties for erroneous claims. More recently, CBP has also assessed recordkeeping penalties for the failure to timely provide requested documentation.

This stands for Customs-Trade Partnership Against Terrorism. MBC Broker is a proud member of this partnership. Members can get additional benefits by joining. We are a proud member of this organization. Please read the following carefully:

Container and Trailer, Security

Whether you are a C-TPAT member or not, it is critical for you to have security procedures in place at the point of stuffing, procedures to inspect, properly seal and maintain the integrity of the shipping containers and trailers. Below are the seven-point inspection process for empty containers prior to the loading the cargo, as well as the seventeen-point inspection process for all trailers/tractors. They should read passed on to your suppliers and be followed.

Container Inspection

Procedures must be in place to verify the physical integrity of the container structure prior to stuffing, to include the reliability of the locking mechanisms of the doors. A seven-point inspection process is recommended for all containers:

Front wall

Left side

Right side

Ceiling/Roof

Inside/Outside doors

Outside/Undercarriage

Container and Trailer, Seals

The sealing of trailers and containers, to include continuous seal integrity, are crucial elements of a secure supply chain. Seals used to secure loaded containers and trailers bound for the U.S. must meet or exceed the current PAS ISO 17712 standards for high security seals. All loaded U.S.-bound containers and trailers must have a PAS ISO 17712 high-security seal affixed. When necessary, you need to institute procedures for recognizing and reporting compromised seals to CBP, us or the appropriate foreign authority.

Container and Trailer, Inspection

Procedures should be in place to verify the physical integrity of the trailer structure prior to stuffing, to include the reliability of the locking mechanisms of the doors.

17 Point Tractor and Trailer Inspection

Bumper

Engine

Tires (truck & trailer)

Floor

Fuel tanks

Cab / storage compartments

Air Tanks

Drive Shafts

Fifth Wheel

Outside / Undercarriage

Floor

Inside / Outside Doors

Side Walls

Ceiling / Roof

Front Wall

Refrigerated Unit

Exhaust

Documentation

All documentation sent to us for clearance processing must be fully clear and legible. If they are not, you must contact the supplier and obtain clear copies before we can process your shipment. We suggest you have them scanned in and e-mailed to us in Adobe PDF format.

Want to join C-TPAT?

We urge all of our customers to join C-TPAT. After joining and getting fully certified, you will enjoy benefits such as less exams and faster processing of your entries as well as many other benefits.

This is also known as the Importers Security Filing or 10+2. The 10+2 refers to 10 data elements from the importer and the other 2 data elements are from the carrier.

ISF started enforcement on January 26, 2009. Full enforcement with penalties and sanctions were delayed for 1 year to give the trade time to develop procedures, software and other tools to implement the process. Many companies took the time to develop those processes during this 1 year period and were transmitting error free ISF’s during that time.

As with anything, there is a cost associated with it. Some importers took the position that they would wait until penalties came about until they started ISF because they were short sighted and only saw that they could save a few dollars and wait until the last minute. In reality, Customs will take this into account when they get a late or incorrect ISF and need to issue a penalty. There can be two penalties per shipment and up to $5,000 each for a total penalty of $10,000 per shipment. When it comes time to mitigate the penalty, those that did not file until the last possible moment will lose out and end up with a higher penalty.

In order to comply with ISF, please go to the forms page and download the ISF worksheet. Have your supplier fill it out and send back to us at least 3-4 days prior to the vessel loading.

With limited exceptions, all shipments coming into the US need to be covered by a bond. There are two basic import bonds, annual and single.

Annual Bond. Almost all importers have a regular annual bond. The minimum bond is $50,000 and is good for 12 months from the date of enactment. The amount could vary depending on what you import and the value of those imports and the duties paid in a given year. The application must be completed and will give us the information to determine the amount. The final amount determination will be made by Customs.

Single Bond. Single bonds, or SEB’s are used when you don’t have an annual bond. They can only be used locally and cannot be used for remote filing. The amount is terminated by the value, the duty and what the item is and/or other government agencies subject to.

The first thing a broker needs from you is a power of attorney packet completed. This contains essential items before any business conducted.
Next, give us the import documents. We need the following:

	1) Commercial invoice. This shipment must list the full shippers and importers name and address. It also lists the items being imported and their values. We may have more questions on this after our review.

	2) Packing List. This item lists the items you are importing and tells us how they are packed and in which carton numbers the items are along with their quantities.

	3) Bill of Lading or Airwaybill. This is the transport document. We need this to determine who owns the shipment as well as how it is coming in. In some cases, the original bill of lading will need to be surrendered to the forwarder/carrier prior to you getting access to the shipment.

	4) Certificates. There may be other forms required. We’ll advise depending on your particular items.
Once we receive those items, we’ll check on the arrival and process the entry with Customs and other government agencies as needed.

After clearance, you can pick up the shipment yourself or we can arrange delivery. We can also use any designed trucker you have been using.
